NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. The Domain.com’s Apple® Gift Card Giveaway (the “Giveaway”) will begin at 12:00 a.m. Pacific Time (“PT”) on September 5, 2008, and ends at 11:59 p.m. PT on October 30, 2008 (the “Entry Period”). The two-week entry period for each drawing begins on Friday and ends on Thursday of each week beginning September 5, 2008 (“Drawing Period”). Drawings will be held September 19, 2008, October 3, 2008, October 17, 2008, and October 31, 2008. The Giveaway is sponsored by Dotster, Inc. (8100 NE Parkway Drive, Suite 300, Vancouver, WA 98662) (“Dotster”), who is solely responsible for all aspects of this Giveaway. Dotster’s computer shall be deemed the official time keeping device for the Giveaway.

ELIGIBILITY: The Giveaway is open to legal residents of the 50 United States and the District of Columbia 18 years of age or older (19 years or older in Alabama and Nebraska) at the time of entry. Employees of Dotster and its affiliates, subsidiaries, agents, distributors, wholesalers, retailers, sales reps, and their advertising and promotional agencies and suppliers of promotion materials, and the members of the immediate families and households of each are not eligible. The Giveaway is subject to all federal, state, and local laws and regulations and is void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and otherwise where prohibited, taxed or restricted by law.

HOW TO ENTER: There are two ways to enter the Giveaway: (i) you will automatically be entered for the Giveaway by making a purchase at www.domain.com during the Entry Period; or (ii) hand-print the words “Dotster Apple® Gift Card Giveaway,” along with your name, address, telephone number (including area code) on a 3” x 5” card and mail it in an envelope with first class postage affixed to the address above. All entries must be postmarked by October 29, 2008, and received by October 30, 2008. No mechanically reproduced entries or entries submitted by facsimile will be accepted. Dotster assumes no responsibility for late, damaged, ineligible, incomplete, lost, postage-due or misdirected entries. All entries are the property of Dotster and will not be returned.
You are not a winner until your prize claim is validated and you receive official written notification from Dotster by email. All potential winning plays are subject to verification by Dotster, whose decision is final and binding in all matters related to the Giveaway. You are not a winner of any prize, even if the Giveaway should so indicate, unless and until your eligibility and the potential winning play has been verified and you have been notified that verification is complete. Dotster will not accept screen shots or other evidence of winning in lieu of its validation process. Any play that occurs after the system has failed for any reason is deemed a defective play and is void and will not be honored. Winners will be required to sign an affidavit of eligibility and release of liability/publicity (where permitted) within 21 days of the date on the notification letter or the prize will be forfeited and awarded to an alternate winner. If any prize or prize notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner.

GIVEAWAY: During each Drawing Period, one (1) Giveaway message will be randomly created. Eligible entrants who receive a Giveaway message and satisfactorily complete the verification process will win the prize indicated, subject to these Official Rules. Winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Odds of winning are based on the number of Giveaway plays during the Entry Period. If a potential winner cannot be contacted within seven (7) days after the first attempt to contact him/her, Dotster will select an alternate potential winner in his/her place at random from all eligible entries received. Winners of a Giveaway prize who meet all of the eligibility requirements, are verified, and have fully complied with these Official Rules, will receive their prize within approximately four (4) weeks after the conclusion of the Entry Period.

PRIZES: FOUR (4) PRIZES: The prize is an Apple® gift card in the amount of $500.00 (US) (retail value of $500US). Use of such gift card is subject to any and all terms and conditions applied by Apple® to its gift cards. All expenses and costs not expressly listed in the prize description are solely the winner’s responsibility. Prizes are nontransferable until awarded and non-refundable and must be accepted as awarded. No cash or other substitution may be made except by Dotster, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by Dotster in its sole discretion. All prize winners are solely responsible for all taxes associated with the receipt of any prize.

GENERAL CONDITIONS: Dotster reserves the right to cancel, suspend, and/or modify the Giveaway if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Giveaway, as determined by Dotster in its sole discretion. In such event, Dotster reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Dotster reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Dotster reserves the right to seek damages from any such person to the fullest extent permitted by law. Dotster assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Dotster also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any email or entry to be received by Dotster on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Dotster’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address.

AGREEMENT TO OFFICIAL RULES: Your participation in the Giveaway constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of Dotster, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

PUBLICITY: Except where prohibited, participation in the Giveaway constitutes winner’s consent to Dotster’s use of winner’s name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media worldwide without further payment or consideration.

PRIVACY: All information submitted by you as part of this Giveaway will be shared with Dotster. Such information shall be treated in accordance with Dotster’s privacy policy, accessible from www.domain.com.

RELEASE: By receipt of a prize, winner agrees to release and hold harmless Dotster and its officers, directors, shareholders, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) any inaccurate information, whether caused by entrants or printing errors; (b) unauthorized human intervention in any part of the Giveaway; (c) technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; (d) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (e) lost, delayed, misdirected, or undeliverable mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from your participation in the Giveaway or receipt of any prize.

DISPUTES: Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Washington; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Giveaway, but in no event attorneys’ fees; and (c) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Dotster in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Washington.

Vermont residents may omit return postage for Official Rules requests.
